- Limited Tort Insurance
Limited tort coverage is cheaper than full tort coverage because it takes away a person’s right to pursue financial compensation for injuries that they sustained in an accident; a person will still be precluded, even if they were not at fault. When choosing the cheaper option of a limited tort, the policyholder is asked to sign away their rights to make a claim for personal injuries in exchange for a cheaper insurance rate.
The only compensation that a person can receive when they are covered by the limited tort option is for economic damages. These things could be considered out-of-pocket expenses, such as property damage costs, medical bills, and lost wages. Your right to sue for pain and suffering is limited.
The ONLY exception to this rule is if the policyholder suffered a “serious injury.” A “serious injury” is defined under Pennsylvania auto law as one that results in at least one of the below-listed types of injuries:
- The injury results in death; or
- The injury results in permanent scarring or disfigurement; or
- The injury causes severe impairment of body function.
The most commonly used exception is the last one, “serious impairment of a body function.” This exception, however, is tough to prove, as it is a subjective definition.
In addition, this one is a grey area, unlike the other two exceptions. What is serious to one person may not be severe to another. Therefore, electing the limited tort option on your automobile insurance policy is very risky.
- Full Tort Insurance
The best choice is to select the full tort option on your automobile insurance policy. Yes, it is more expensive than limited tort. However, full tort enables an injured person to be compensated for any type of injury, severe or not.
